I.       TERMS AND CONDITIONS

1. ACCEPTING THESE TERMS

This document, our rules, policies and the other documents referenced make up our Terms and Conditions (“Terms”). The Terms are a legally binding contract between you and Agile Leadership Success (“ALS”). This contract sets out your rights and responsibilities when you use our website. Please read them carefully.

2. CHANGES

Agile Leadership Success may amend the Terms at any time by posting a revised version on our website. The revised version will be effective at the time we post it.

3. SERVICES

3.1 Planning and improving efficiency are key ingredients to successful career and business management. Agile Leadership Success offers management and career consulting services that will propel your career or business to the next level.

3.2 Agile Leadership Success shall provide and perform the above mentioned services on the terms and conditions of this Agreement and will do so:

  • in compliance with all applicable laws, regulations, codes of practice and professional standards.

  • with reasonable skill and care.

  • in accordance with the terms of this Agreement.

  • in accordance with good professional practice.

4. PROHIBITED USES

You may not use, or encourage, promote, facilitate, instruct, or induce others to use, the website or website services for any activities that violate any law, statute, ordinance or regulation; for any other illegal or fraudulent purpose or any purpose that is harmful to others; or to transmit, store, display, distribute or otherwise make available content that is illegal, fraudulent or harmful to others.

ALS customers may not transfer career, business, or other consultative services without prior written approval from ALS.

All ALS content is subject to copyright law. Unless expressly permitted by law, every form of utilizing, reproducing or processing works subject to copyright protection on our web pages requires the prior consent of the respective owner of the rights.

5. SECURITY

ALS ensures the protection and honesty of the data it gathers by utilizing fitting authoritative conventions, specialized shields, and actual security controls intended to restrict access, identify and forestall the unapproved access, inappropriate divulgence, adjustment, or obliteration of the data under its influence.

6. YOUR OBLIGATIONS

6.1 You shall provide us with such information and access as we shall reasonably require in order to provide the services.

6.2 You shall make such decisions and provide such instructions that shall enable us to carry out our services without hiccups.

7. TERMINATION

7.1 Agile Leadership Success reserves the right to change, suspend, limit or discontinue any of its services, in whole or in part at any time for any reason, without notice (unless required by law).

7.2 Agile Leadership Success may refuse service to anyone and may terminate or suspend your services and your access to the website in whole or in part at any time, for any reason, without notice (unless required by law).

8. LIMITATIONS

In no event will Agile Leadership Success be liable to you for any indirect, incidental, special, consequential or punitive damages (including damages for loss of profits, goodwill, or any other intangible loss) arising out of or relating to your access to or use of, or your inability to access or use, the services or any materials or content available through the website, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not Agile Leadership Success has been informed of the possibility of damage.

9. INDEMNIFICATION

You agree that you will be responsible for your use of the services, and you agree to defend and indemnify ALS from and against every claim, liability, damage, loss, and expense, including reasonable attorneys’ fees and costs, arising out of or in any way connected with: (i) your access to, use of, or alleged use of, the website; (ii) your violation of any portion of these Terms, any representation, warranty, or agreement referenced in these Terms, or any applicable law or regulation; (iii) your violation of any third party right, including any intellectual property right or publicity, confidentiality, other property, or privacy right; or (iv) any dispute or issue between you and any third party.

 

10. GOVERNING LAW

This Agreement and any claim, controversy or dispute arising under or related to this Agreement shall be governed by and construed in accordance with the internal laws of the state of New York applicable to agreements made and to be performed in such state without regard to conflicts of law principles thereof.

 

11. CONFIDENTIALITY

Agile Leadership Success may during the course of this Agreement and in connection with the services obtain information which is confidential. ALS undertakes to keep the confidential information and not disclose it to third party and shall only use the confidential information only for the purpose for which it has been provided.

12. ENTIRE AGREEMENT

This Agreement contains the entire agreement and understanding among the parties hereto with respect to the subject matter hereof, and supersedes all prior and contemporaneous agreements, understandings, inducements and conditions, express or implied, oral or written, of any nature whatsoever with respect to the subject matter hereof.

II.     CANCELLATION & REFUND POLICY

 1.      Introduction

For purposes of this Refund Policy, “we” or “our” refers to What’s Your Scenario, and “you” or “your” refers to the user. Please read this Refund Policy carefully as it constitutes your agreement with us. 

By engaging us to provide services to you, you agree to be legally bound by this Refund Policy. We reserve the right to change or modify this Refund Policy at any time.

2.      Reschedule Requests

Current Agile Leadership Success customers can reschedule their existing service/appointment by contacting info@agileleadershipsuccess.com. Reschedule requests must be received no later than 72 hours prior to the session start time to qualify for a free one-time reschedule. Unless otherwise noted in executed contract between Agile Leadership Success and the customer, sessions can be scheduled for a mutually agreed upon date/time, as authorized in the service agreement.

3.      Cancellation Requests

User Cancellations

Cancellation requests may be submitted by email. Please note that refunds will be processed in the original form of payment. 

  • Refund requests made more than 7 days prior to a session and/or event series will be subject to an administration fee of 25% of the total service charge. Alternatively, you may request that the original fee be applied towards a future session (e.g., rescheduled) as outlined in this policy.

  • Refund requests made equal or less than 7 days prior to a session and/or event series are subject to a 50% administration fee. Alternatively, you may request that the original fee be applied towards a future session (e.g., rescheduled) as outlined in this policy.

Agile Leadership Success Cancellations

Agile Leadership Success reserves the right to reschedule or cancel, at any time, due to unforeseen circumstances including but not limited to insufficient equipment or speaker availability. We strive to let customers know if a session must be rescheduled or cancelled at least two business days before the session, whenever possible. If Agile Leadership Success cancels a session, you will be given the option to transfer to a later date up to 60 days from the original session date, receive a credit, or refund.

 

4.      Severability                                     

In the event any provision or part of this Refund Policy is found to be invalid or unenforceable, only that particular provision or part so found, and not the entire Refund Policy, will be inoperative.
